Terms of use
These terms apply when you or your organisation use the NOMIC Ramp website, tool, coding guide, templates or online storage. NOMIC Ramp is provided by NOMIC Research Pty Ltd ("NOMIC", "we").
1. Using NOMIC Ramp, and the licence
© NOMIC Research Pty Ltd (ABN 20 638 941 232). All rights reserved. NOMIC Ramp's content, including the coding guide, the course, the calibration exercises, the templates, the reference data and the website text, belongs to NOMIC Research Pty Ltd.
Licence for paying organisations. Airlines, ground handling companies and airports that have paid for a NOMIC Ramp level (see work with us) may use, copy and adapt the materials in that level inside their own organisation, for their own operations, including internal training and safety programmes. Contractors and ground handlers working on the organisation's own operations may use the materials for that work only, not for their other clients. The licence is for the paying organisation: it can't be passed on, and it ends if the organisation stops using NOMIC Ramp.
Not allowed without written permission from NOMIC Research Pty Ltd:
- publishing, sharing or reposting the materials outside your organisation, including online;
- using them to deliver services to another organisation, such as consultancy, training, audits or software;
- any other commercial use, including by consulting companies, or selling them;
- using a member's sign-in on behalf of anyone outside that member's organisation.
The thesis and published research that NOMIC Ramp builds on can be cited in the usual way. Please credit "NOMIC Ramp, NOMIC Research Pty Ltd" when you refer to it.
2. Levels and payment
- The levels and what each includes are on the work with us page. We agree the price with you in writing, in Australian dollars, before you start.
- We send an invoice. Sign-in to a level opens once it is paid.
- Plan is a one-off payment. Self-service audit covers one audit: the materials and the tool for that audit, for 12 months from payment. Supported membership is for a year at a time and includes everything in Self-service for every round in that year.
- The agreed price for a level you have paid for doesn't change during that period.
- Nothing in these terms takes away rights you have under the Australian Consumer Law or other laws that can't be excluded.
3. Your organisation is responsible for its programme and its data
- Your organisation owns its observations and is responsible for them, including how they are collected, used, shared and kept.
- Your organisation is responsible for running its programme in line with the laws, airport rules, company rules and agreements that apply to it, including privacy and workplace laws, and telling crews about observations.
- Observers must not record names, staff numbers, flight numbers, aircraft registrations or anything else that identifies a person.
- Observers' phones keep an observation only until it is sent: once your organisation has it, it is removed from the phone. Your organisation is responsible for keeping its links and devices secure. Anyone with a link can use it. If a link may have reached the wrong person, stop using it and start again with new links.
- Keep backups. If every connected device and link is lost, the online copy can't be unlocked by anyone, including us.
4. Online storage
If your organisation turns on online storage, observations are encrypted on your devices and kept, encrypted, in storage we run on Cloudflare. We may limit how much is stored, remove storage that has not been used for a long time (after telling you where we can), and change or stop the service. Please keep your own backups.
5. Support
Supported members get the support described on the pricing page. For the other levels we don't promise support, but we'll help when we can. If you want us to look at your observations to help you, you can give us access by sending us a link. We use that access only to help you.
6. Provided as is
NOMIC Ramp is provided "as is" and "as available", without any warranty that it will be error-free, always available, or suitable for a particular purpose. It supports your organisation's safety management; it does not replace it, and it is not legal or regulatory advice. Results are links in data, not proof of cause, and decisions based on them are your organisation's.
7. Limits on our liability
To the extent the law allows, NOMIC is not liable for any loss or damage arising from the use of, or inability to use, NOMIC Ramp, including loss of data, loss of profit, or indirect or consequential loss. Where the law implies a guarantee that can't be excluded (for example under the Australian Consumer Law), our liability is limited, where the law allows, to supplying the service again.
8. Changes
We may update these terms. The date of the current version is shown below. Continuing to use NOMIC Ramp after a change means you accept the updated terms.
9. Law
These terms are governed by the laws of New South Wales, Australia.
